Wildfire in Rocky Mountain National Park prompts evacuations

DENVER (Reuters) - A wind-driven wildfire in Rocky Mountain National Park northwest of Denver jumped containment lines overnight, triggering the evacuation of hundreds of people on Saturday, fire officials said.

Wind gusts of more than 70 miles per hour blew flames from the so-called Fern Lake Fire close to dwellings and destroyed at least one cabin, said fire spokeswoman Traci Weaver.

The east side of the park was closed, and authorities called 1,100 cell and home phones, warning people to either evacuate or prepare to leave quickly if winds drive flames their way.

About 200 people went to stay at an evacuation center in a high school in nearby Estes Park after evacuations were ordered early on Saturday, said Nick Christensen, spokesman for the Larimer County Sheriff's Office.

There are no reports of any injuries, Christensen said.

The forced evacuations represented a dangerous development in firefighters' efforts to quell the stubborn Fern Lake Fire, which has burned for nearly two months.

Efforts to battle the fire have been hampered by the steep, rugged terrain, gusty winds that have restricted air resources, and a lack of precipitation, Weaver said.

The blaze, which has blackened some 1,550 acres, was ignited in October by an illegal campfire and is burning through stands of beetle-killed trees.

It was about 40 percent contained before the overnight flare-up, officials said.

Winds subsided after daybreak Saturday, Weaver said, and two heavy air tankers from Southern California were dispatched to the fire. "What we really need is snow," he said.

House Speaker Boehner says no progress in budget talks

WASHINGTON (Reuters) - House Speaker John Boehner said White House and Republican negotiators had made no progress in talks to avert the "fiscal cliff" of sharp tax hikes and deep spending cuts that looms early in January.

"We're nowhere" Boehner, the top House Republican, said on "Fox News Sunday."

"We've put a serious offer on the table by putting revenues up there. ... But the White House has responded with virtually nothing," he said.

Boehner said Congress will never agree to the White House suggestion that the federal debt limit be raised without a congressional vote. "Congress is never going to give up that power. ... It is the only way to leverage the political process." he said.

Syria jets bombard rebel targets on airport road

BEIRUT (Reuters) - Syrian air force jets bombarded rebel targets on Friday close to the Damascus airport road and a regional airline said foreign carriers had halted flights to the capital.

Activists said security forces clashed with rebels trying to topple President Bashar al-Assad around Aqraba and Babilla districts on the southeastern outskirts of Damascus which lead to the international airport.

Internet connections and most telephone lines were down for a second day, the worst communications outage in a 20-month-old uprising in which 40,000 people have been killed and hundreds of thousands forced to flee the country.

The mostly Sunni Muslim rebels who are battling Assad, from Syria's Alawite minority linked to Shi'ite Islam, have been making gains around Syria by overrunning military bases and have been ramping up attacks on Damascus, his seat of power.

A spokesman for a rebel Military Council in Damascus, Musaab Abu Qitada, told Reuters on Thursday they were also trying to "liberate" the airport to stop planes they said were delivering arms to the government.

A resident of central Damascus said he saw black smoke rising from the east and the south of the city on Friday morning and could hear the constant boom of shelling. State television said Assad's forces were fighting rebels in those areas.

U.N. Secretary-General Ban Ki-moon said the conflict had reached "new and appalling heights of brutality and violence".

The government had intensified its campaigns to root out opposition strongholds and increased shelling and air strikes, Ban told the U.N. General Assembly. "Opposition elements also have stepped up their attacks. I am horrified and saddened and condemn the seemingly daily massacres of civilians," he added.

An aviation source in neighboring Jordan said two Syrian Air flights crossed Jordanian air space heading for the Syrian capital on Friday evening and that Damascus airport was open, although international airlines were staying away.

The head of the national airline Syria Air said its services were operating according to schedule, state television reported.

EgyptAir and Emirates have suspended flights to Damascus in response to the recent violence and there was no sign that Air Arabia and flydubai had flown scheduled trips on Friday.

"Airlines are not operating to Damascus today," said a Dubai-based airline official.

The Syrian Observatory for Human Rights, a British-based opposition monitoring group, said jets were bombarding targets in rural areas around Aqraba and Babilla.

The Observatory's director, Rami Abdelrahman, said the airport road was open, but there was minimal traffic.

"A DECISIVE PHASE"

U.S. and European officials said rebels were making gains in Syria, gradually eroding Assad's power, but said the fighting had not yet shifted completely in their favour.

A Damascus-based diplomat said he believed the escalation in fighting around the capital was part of a government offensive which aimed to seal off the state-controlled centre of the city from rebel-held rural areas to the south and east.

Activists say Assad's forces have also been shelling the Daraya district to the southwest of the city, trying to prevent rebels from cementing their hold of an area which could give them a presence in a continuous arc from the northeast to southwest of the capital's outer districts.

"I don't know whether the shelling has succeeded in pushing back the FSA (rebels) - experience shows that they return very quickly anyway," the diplomat said. "We seem to be entering a decisive phase of the Damascus offensive."

At least 12 Lebanese gunmen were killed in a Syrian army ambush in the central Syrian province of Homs, a security source said on Friday, highlighting how Lebanon's neighbours are being dragged into the war.

The sources said the Lebanese men were killed near the town of Tel Kalakh and were from majority Sunni northern areas of Lebanon.

WHO CUT THE INTERNET?

Syria's Internet shut down on Thursday, a move which activists blamed on authorities but which authorities variously attributed to a "terrorist" attack or a technical fault.

Global hacking network Anonymous accused Syria's government of blocking communications to silence critics and said it would respond by attacking Syrian government websites around the world.

"As we discovered in Egypt, where the dictator (Hosni) Mubarak did something similar - this is not damage that can be easily or quickly repaired," Anonymous said, referring to an Internet outage during the 2011 uprising in Egypt.

French foreign ministry spokesman Philippe Lalliot said the communications cut was of a matter of "extreme concern".

"It is another demonstration of what the Damascus regime is doing to hold its people hostage. We call on the Damascus regime to reestablish communications without delay," he said.

CloudFlare, a firm that helps accelerate Internet traffic, said on its blog saboteurs would have had to simultaneously cut three undersea cables into the Mediterranean city of Tartous and also an overland cable through Turkey in order to cut off the entire country's Internet access.

"That is unlikely to have happened," it said.

U.S. chefs' solution for invading Frankenfish? Eat 'em

WASHINGTON (Reuters) - The northern snakehead is known as "Frankenfish" and "rattlesnakes with fins," and some chefs say one way to stop the predatory, fast-spreading fish is obvious - with a fork.

With a reputation as fearsome as its name, the voracious snakehead fish has intruded throughout much of the Potomac River basin in Virginia and Maryland in the last decade, snapping up anything that gets in front of it.

Putting the torpedo-shaped snakehead on the menu is Washington-area restaurants' way of helping to control the Asian newcomer. Chefs said they have a key weapon on their side - humans' zest for eating up other species to the vanishing point.

"When man turns its attention to an animal, it's very difficult for the animal. He (the snakehead) is dangerous, but chefs are more dangerous," said David Stein, executive chef at Tony & Joe's Seafood Place in Washington.

He praised the snakehead for its dense, meaty, white flesh with a mild taste that is ideal for anything from grilling to sauteing. But given the name, snakehead ceviche might be going too far.

"The guy that orders that gets it for free," Stein said.

The northern snakehead, or Channa argus, has joined a tankful of invasive fish that U.S. authorities are urging people to control by eating them.

Lionfish in the Caribbean, Asian carp in the Mississippi River basin and blue catfish in Virginia rivers are among other newcomers that environmentalists want to see on a dinner plate.

SLAB-LIKE FLESH

But the snakehead stands out among its invasive peers because its slab-like flesh and its minimal shrinkage is seemingly ideal for white-tablecloth restaurants.

Some four restaurants in the Baltimore and Washington area serve it regularly, according to the Maryland Department of Natural Resources.

At Tony & Joe's, snakehead appetizers cost $10 to $11, and entrees about $26. Maryland is the only state with a commercial market and the limited supply is keeping prices high.

"They're really amazing. Probably if it was called any other name than snakehead, people would be more willing to give them a try," Stein said, admiring a 7-pound (3-kg) fish that had been killed by bow and arrow.

Snakeheads are hardy, fast-growing, voracious and prolific. They got their start in the Potomac through releases from aquariums and the live fish trade, and have turned up in such places as California and Florida. The name comes from its coarse scales, boa constrictor-like coloring and a reptilian snout with a mouth featuring dog-like teeth.

The fish are air breathers that can last for days out of water. Even when gutted and with their throats cut, they gape for breath, said John Rorapaugh, director of sustainability and sales at ProFish, a Washington wholesaler.

"Once they get to mature size, they are on top of the food chain and are ravenous," he said.

Mice, birds, frogs, other fish, and even AA batteries have turned up inside snakeheads, Rorapaugh said. The fish weigh from about 8 to 15 pounds when mature.

He said he pays about $5 a pound ($12.50 a kg) for snakehead, and has shipped some outside the Washington area, including to New York's upscale Gramercy Tavern.

Josh Newhard, an expert on the snakehead with the U.S. Fish and Wildlife Service, said it was too early to say what the snakehead's long-term impact would be on its invaded environment.

Native species have shown no sign of decrease despite the fish's "remarkable" spread, he said.

"The potential is really high for them to impact other fish species. The fact that people want to remove them from the system is really good," he said.

Texas inmate waits more than 30 years for retrial

(AP) ? A Kansas man who remains in a Texas prison more than 30 years after his murder conviction was overturned has become the subject of a fight between the state, which insists he's being legally held, and a federal appeals court that says he's wrongly imprisoned.

Jerry Hartfield, whose conviction was overturned in 1983, maintains his constitutional right to a speedy trial has been violated after the state failed to retry him but also didn't set him free.

A federal appeals court has agreed with him, but he's unlikely to receive a new trial soon after the same court, in a spat with the state attorney general's office, sent his case back to the Texas Court of Criminal Appeals on Wednesday with a request that it define the status of its ruling overturning Hartfield's conviction. If the Texas appeals court accepts the federal appeals court's request, it could set off a new series of legal proceedings that ties up the attorney general's office and drags out the case.

Hartfield's federal public defender, Kenneth R. Hawk II, said his client has been "stuck" in the Texas prison system for more than three decades because no one seems to know what to do with his case.

"It's one of those one-in-a-million deals," Hawk said. "When you see it, it's kind of breathtaking."

Hartfield, now 56, was 21 when he was convicted in the 1976 slaying of a 55-year-old ticket agent at a bus station in Bay City. Eunice Job Lowe was beaten with a pickax and her body left in a bus station storeroom, where her 19-year-old daughter found it.

Hartfield was convicted and sentenced to die, but in 1980, a Texas appeals court ordered a new trial, saying a potential juror had been wrongly excluded from the original trial because of her reservations about imposing the death penalty.

State attorneys twice requested a rehearing on that decision, with the appeals court rejecting their second request on March 4, 1983.

Eleven days later, then Gov. Mark White commuted Hartfield's death sentence to life in prison. At that point, both sides let the case lie for about 20 years.

Hartfield, described in court documents as illiterate and mentally impaired with an IQ of 51, got the ball rolling again in 2006, when he filed a handwritten writ of habeas corpus with the help of another inmate. The writ essentially said he should be retried or set free. It was rejected twice by the Texas Court of Criminal Appeals before Hartfield submitted it in the federal court system.

A judge there agreed with him.

"Hartfield's position is as straightforward and subtle as a freight train," U.S. District Judge Lynn Hughes said.

The state had claimed that Hartfield was legally serving the life sentence ordered by White. It said he had had one year under federal rules to file an appeal on any aspect of his case, and that year started when the retrial was ordered in 1983.

Hughes disagreed, saying the clock on an appeal doesn't start until there's a conviction, and none exists in this case.

"The court's mandate was never recalled, its decision never overturned, the conviction never reinstated; yet Hartfield never received the 'entirely new trial' ordered by the court," he wrote.

The state's appeal of Hughes' decision eventually ended up before a three-judge panel of the 5th U.S. Circuit Court of Appeals, which described the state's defense of Hartfield's incarceration as "disturbingly unprofessional" in its Wednesday decision.

The panel had said in October that it couldn't make a formal decision on Hartfield's complaint that his constitutional right to a speedy trial has been violated because the issue hadn't been resolved yet by his state trial court in Wharton County, about 60 miles southwest of Houston.

But the federal appeals judges left little doubt about their position, saying the state appeals court reversal 30 years ago meant "there was no longer a death sentence to commute, and thus the governor's order could not have had any effect."

The state's request for a rehearing on that decision led to Wednesday's ruling.

Hartfield, who is originally from Wichita, Kan., has been moved to a Texas prison hospital for an undisclosed illness and was not available for an interview.

Hawk said he'd discussed the court activity with Hartfield but found it useless to write him.

"Because he can't read it," he said.
